Hey folks, I was let go from my civil service job without what seems like any fair due process. They said it was because of a supposed conviction, but I’ve never actually been convicted. Got the record cleared and everything, but it didn’t matter by then. Anyone been through something like this?
Wow, that’s a tough situation. So they fired you over something that never even happened?

Exactly! I even got it expunged to show there was no real conviction, but they already let me go.

That’s seriously unfair. Did they at least give you a chance to explain?
Did you try filing a complaint with the EEOC? They’re usually the ones who handle wrongful termination stuff.

No, I missed out on that. My union lawyer didn’t really mention anything about it.

I think the deadline for the EEOC is pretty strict, like under a year from when it happened.
If the EEOC deadline has passed, maybe look into legal aid in your area? They might be able to help.

Not a bad idea, I hadn’t considered legal aid. I’ll look into it.

Some law schools even have clinics where they offer free help on cases like this.
Did your union lawyer not give you any guidance on timelines or filing? Sounds like they dropped the ball.

Yeah, they didn’t really guide me through anything. Feels like I got left in the dark.

Maybe bring it up with the union? They should have been there to help you.
Do civil service jobs have any specific protections for due process? Seems like that would be standard.

That’s what I thought too, but not sure where to even start since I missed the EEOC window.

A labor attorney could help you understand your rights here. They’d know more about due process requirements.
