Anyone dealt with contractor agreements and not getting paid?

I signed a contractor agreement with a wellness clinic, and the contract says I should be paid for services rendered every 2 weeks. But my boss says it’s a buildup process and doesn’t pay me correctly each time. He’s also controlling when I come in for clients, marketing tools, and what procedures I do. It feels more like an employee/employer situation. Now he owes me over $2800 and wants me to sign something to get my last check, plus pay him $500 for quitting early. What can I do?

Yeah, sounds like you’re being treated as an employee, not a contractor. If it’s not in the contract, he can’t just make up new rules. Maybe look into filing a wage claim?

That’s what I was thinking… I didn’t realize how bad it was until now. I’ll look into that wage claim thing. Thanks!

Wage claim? What’s that exactly?

Oh, it’s basically when you file a complaint because you weren’t paid properly. You can do it with your local labor board.

This is super sketchy. No way he can just hold your pay like that and charge you $500. You should def see a lawyer or file something official.

Yeah, he’s really pushing for this $500 fee. But I didn’t even notice it in the contract until now. I’ll definitely be looking at my options. Thanks!

If he’s controlling all your work stuff, it’s probably misclassification. You might be entitled to a lot more if they find you’re really an employee!

Good point! That’s what my lawyer mentioned too. It’s starting to seem like I’ve been misclassified this whole time.

I’d say don’t sign anything without a lawyer looking at it. He can’t force you into a new agreement to get your paycheck.

Exactly, I don’t want to get trapped into something else. I’m definitely holding off on signing anything.

Maybe take him to small claims court? Sounds like a straight-up breach of contract situation. You’re definitely owed that money.

I think that’s where this is headed if he doesn’t pay up. Hopefully, it doesn’t come to that, but I’m ready if it does.
