Docket call tomorrow... attend if motion to extend is pending?

We have a Zoom docket call scheduled tomorrow for our student loan adversary proceeding in Texas. We filed a motion to extend the deadlines, but the court hasn’t ruled on it yet. Should we still attend the hearing? What’s the usual process for this?

You should definitely show up. Courts usually want updates on your case, even if motions are undecided.

Got it. So we just explain the situation about the pending motion?

Yep, just let them know why you filed the motion and how it impacts your case. They’ll probably ask about it.

If you skip it, the court might think you’re not serious about the case. That could backfire.

Wow, didn’t think of that. Thanks for the warning!

You can use the hearing to update the judge about the motion. Sometimes they decide on it during the call.

That’s helpful to know. Would they also adjust the deadlines if they approve it then?

Yep, they’ll usually explain any new timelines right there. Be ready to take notes!

Until the motion is decided, you’re technically still on the current deadlines. Plan accordingly.

Good advice. We’ll work as if the original deadlines still apply for now.

What exactly is a docket call? I don’t think I’ve dealt with one before.

It’s basically a check-in with the court. They ask how things are going and what the next steps are.

Thanks for explaining! That’s useful for anyone who isn’t familiar with it.
