Facing defamation and retaliation... what can I do?

I’m dealing with a frustrating situation at work involving defamation and possible retaliation. A temporary para who was friends with the previous teacher spread a rumor that I said something inappropriate to him, supposedly in front of a student. This rumor somehow made its way to the student’s parent, who then filed a complaint against me.

I wasn’t even informed about this until months after it allegedly happened. I’ve talked to the assistant superintendent and my union rep, and they told me they’d investigate. They also questioned the other three paras who were present at the time, but I haven’t heard anything since. The only thing I’ve received is a copy of the initial complaint.

What’s even worse is that I haven’t been offered any new position since this started. It feels like I’m being punished without cause, and I don’t know what my next steps should be. Shouldn’t they have updated me during the investigation? And is this kind of retaliation even legal?

That’s awful. Have you reached out to them again for an update on the investigation?

I have, but no one has responded to me so far. It’s really frustrating.

You might want to put your request in writing. A formal letter could push them to respond.

Not being offered any position definitely sounds like retaliation. Did they give you a reason for it?

No, they haven’t given me any explanation. It feels like they’re avoiding me entirely.

You should document everything, including their lack of communication. It might be useful if you escalate this.

Have you considered filing a grievance with the district? They’re supposed to respond if you take that route.

I haven’t yet, but I’m starting to think that might be necessary.

It’s worth doing. A formal grievance puts more pressure on them to follow up.

Defamation can have serious consequences for your career. Have you thought about getting legal advice?

I’ve thought about it, but I wasn’t sure if I have enough to move forward legally.

A lawyer could help you figure out your options. Even if it’s just for advice, it could be worth it.

Make sure you’re keeping a record of everything—emails, conversations, and even their lack of responses.

That’s a good idea. I’ll start documenting everything moving forward.

Also, request updates in writing. That way, you have proof if they continue to ignore you.
