I have a question about wage verification forms. A part-time employee got hit by a car during their day off and filed an auto claim with the driver’s insurance. Now, the insurance is asking for wage verification, but the employee has a super inconsistent work schedule. They only worked as a substitute teacher for a church before the accident. Does the church need to fill out these forms if they don’t have an HR department?
Is the employee trying to get wage compensation from the driver’s insurance?
Yeah, they might get wage compensation from the insurance. Not totally sure yet tho.
If that’s the case, they might need to give employment records or pay stubs. Does the church have any records?
If they don’t have records, can you calculate the total hours worked and divide it by the weeks before the accident?
Good idea. She worked like 2-4 hours inconsistently each week before June 2024. So I guess that could work
Has the church been forced to provide this info by a court or something?
No, it’s just a regular request through the mail. Nothing from the court.
Oh, in that case, the church doesn’t have to fill it out if they don’t want to. Unless there’s a subpoena involved, they can give as little info as they want.
Got it, thanks! So the employee can just give the paystub to the insurance, right?
Exactly! They’re not required to give more than that unless a court says otherwise.
Is the church obligated to fill out that NYS NF-6 form for the employee?
I’m not sure, but I think it depends on whether they got an official request to file it.
Yeah, unless there’s a formal request, the church doesn’t have to fill it out. They can just ignore it until it’s really required.
