Is it legal to fire someone just for being sick?

I’ve been at my job for nine years, no issues or write-ups ever. I got really sick recently, ended up in the hospital, and when I came back to work, they fired me. They said I was a ‘liability.’ It feels so unfair—can they even do that? Has anyone else been in a situation like this?

That’s awful. Did they give you any formal reason, or was it just the ‘liability’ excuse?

Nope, just the liability thing. No warning, no explanation. It was really sudden.

Sounds like they’re trying to avoid dealing with your health situation. Did you have any kind of doctor’s note?

Unfortunately, in a lot of states, they can fire you for almost anything unless it’s clearly against the law.

That’s what I was afraid of. It just feels wrong after so many years there.

Even if it’s legal, it’s a terrible way to treat a loyal employee. You might wanna check with a lawyer.

Did you qualify for FMLA? That could have protected your job if you were out for a medical reason.

I’m not sure. I didn’t file for leave or anything formal since I thought I’d be back quickly. How does it work?

It covers your job for medical leave if you meet certain requirements, like working enough hours over the past year.

It really sounds like they were looking for a way to get rid of you. Was there anything else going on?

Not that I know of. Everything seemed fine until I got sick. No complaints or anything before this.

If it was sudden like that, it might be worth digging into their history to see if they’ve done this to others.

You should absolutely talk to a lawyer. Even if they technically can fire you, there might be something worth pursuing.

I think I’ll start looking into that. This whole thing just feels so unfair after everything.

Good idea. A lawyer might catch something in the details that could help you.
