Is this negligence or just bad protocol...?

I couldn’t get home in time to meet my son with special needs when his school bus dropped him off. There was an accident on the freeway, and I tried calling the school, his teacher, and transportation, but no one picked up. Later, my neighbor told me the driver handed my son to a stranger without confirming anything with us first. Thankfully, my son is fine, but can they be held responsible for something like this? It feels so wrong.

This sounds so upsetting. Did you report it to the school yet?

Not yet. I’m trying to figure out if anything will actually come from it first.

Even if no legal case, they need to know this isn’t okay.

Legally, it might be tough since your son wasn’t harmed. How did he react to the situation?

He didn’t notice anything, but that’s kind of why I’m extra worried. He wouldn’t know if something was wrong.

That makes sense. IDK if negligence laws would apply here, though.

Aren’t drivers supposed to verify who picks up the kids? This seems like a breach of protocol.

That’s what I thought too! I’m shocked they just handed him off like that.

Yeah, they usually call the parents first. This sounds like a big mistake on their part.

Even if no one got hurt, couldn’t this count as emotional distress for you?

I was absolutely panicking the whole time. I just don’t know if that holds up legally.

It might! Emotional distress cases are tricky, but maybe bring it up in your complaint.
