So, my ex-employer said I was let go due to a reduction in force, but they sent me the notice while I was still on FMLA. They timed the termination for when my FMLA was up, but I was supposed to still be on short-term disability. Anyone else had something like this happen? Should I be talking to a lawyer?
Yeah, I’ve heard of this happening before. Did you file a formal complaint about anything before they let you go?
Yeah, I did. I reported discrimination and retaliation before going on FMLA, but the HR investigator never followed up. They just ignored me.
Wow, that sounds shady. It could definitely be worth talking to a lawyer about that, especially with the timing and lack of response from HR.
IDK much about this, but if you were on FMLA, aren’t they supposed to hold your job for you? Seems like something’s not right here.
Yeah, that’s what I thought too. I’ve been looking into it, and it seems like they can’t fire you for being on FMLA, but they claim it was a reduction in force…
Might still be worth checking with a lawyer, especially since you mentioned the short-term disability thing too. Timing seems fishy.
If they didn’t follow up on your internal complaint, that’s another red flag. They’re supposed to investigate stuff like that. You should definitely talk to a lawyer!
Yeah, that’s what I’m thinking. HR just ghosted me after saying they’d investigate. Thanks for the advice!
When I had issues with my employer not responding, I went to the EEOC. Might be worth looking into if you feel like they’re retaliating against you.
Oh, I didn’t even think of that! I’ll check out the EEOC website. Thanks!
Totally talk to a lawyer! If they fired you while you were still supposed to be on disability, that’s super sketchy. Definitely don’t let them get away with it.
