My disability provider says they overpaid me by $3,000 over two years and now want it back in 30 days. I read something about Kansas law possibly waiving overpayments if it’s not your fault. The mistake wasn’t mine—they admitted they miscalculated my benefits. Do I have any options here, or do I have to pay it back?
That’s tough. Did you check your policy? Some plans allow for waivers if the overpayment wasn’t your fault.

Agreed. Look for anything about hardship provisions or waivers. Those might help in this situation.

Good idea. I’ll dig into the policy and see if there’s anything about waivers or repayment terms.
Did they explain how they came up with the overpayment amount? That could help if you plan to dispute it.

They just said it was a mistake in calculating my benefits but didn’t go into detail.

Might be worth asking for a detailed breakdown. Sometimes that info can make a difference in appealing it.
Is there anything in Kansas law that actually supports waiving overpayments, or was it more of a general suggestion?

I thought I read something about waivers if it’s not your fault, but I’m not sure how solid that is.

You might want to double-check with a legal expert. Sometimes state laws are tricky to interpret.
Have you talked to the insurance company about a repayment plan? Most will work with you if the full amount is a problem.

Not yet, but I probably will. No way I can pay back $3,000 in a month.

They’ll probably spread it out over time. It’s worth asking—they don’t usually want people to default on payments.
Who’s your disability provider? Some companies are stricter than others about these things.

It’s UNUM. Not sure how flexible they are with repayment options.

Got it. Hopefully, they’re willing to work with you on this.
