I’ve been dealing with a tough case in Texas for two years, and my lawyer hasn’t let me testify or defend myself properly. I feel like they’re siding with the opposition. I don’t have the funds for a new attorney, so I’ll need to represent myself. How do I officially fire my current lawyer, and what steps should I take to prepare to go pro se?
You’ll need to terminate them in writing. An email works, but make sure it’s clear and saves as a record.

Thanks. Do they have to agree to step down, or can they challenge it?
@Mal
Nope, they can’t challenge it. Once you let them know, they’ll file a motion to withdraw with the court.
Make sure you ask for all your case files from your lawyer. You’ll need those to represent yourself.

Good idea. Should I ask for them before I fire the lawyer?

Definitely. It’s easier to get everything while they’re still representing you.
Have you looked into legal aid? They might be able to help if you can’t afford another attorney.

Not yet. Do you know where to start for that in Texas?

Try the Texas Bar Association or check with local law schools. They often have free legal clinics.
When you go pro se, you’ll need to notify the court. It’s called filing an appearance as your own lawyer.

Thanks! Should I do that before my next hearing or during it?

It’s best to file it before the hearing so the court knows ahead of time.
Do you have a plan to respond to the opposition’s claims? You’ll need to be ready to defend yourself clearly.

I have notes, but I’m not sure how to organize them. Any tips on structuring my arguments?
@Mal
Start with the main facts that counter their claims. Practice presenting your points so you feel confident.
