What’s next after filing for a motion to stay?

Hey everyone, we’re based in Texas and working through a student loan adversary proceeding. There’s a joint pre-trial deadline on the 18th, but we’re in settlement discussions with one of the lenders. We’ve sent out a motion for an extension or stay, and it looks like neither party is objecting. What’s the next step? Also, how might this impact future deadlines?

If no one’s opposing, you’ll just need to formally file it with the court. Did you explain why you need it?

Yep, we explained it’s because of ongoing settlement talks and current deadlines. Think that’ll help?

Absolutely. Courts usually grant these if both sides agree and it’s reasonable.

Once it’s approved, the court will probably set updated deadlines. Are you prepped for the new timeline?

We’re trying to be. Any advice on staying on top of new deadlines?

Use a calendar or task manager app to track everything. Makes it way easier!

What if the judge doesn’t grant the stay? Do you have a backup plan?

Not yet, but we’re hopeful since neither party objected. Would the court still say no?

Unlikely. As long as your motion is clear and justified, it should be fine.

Wait, what’s the difference between an extension and a stay? Aren’t they the same?

Not quite! An extension gives you more time, but a stay pauses everything entirely.

Exactly. Extensions are for deadlines; stays freeze all court actions temporarily.

So when do you find out if the motion is approved? Does it take long?

Not sure yet. I’m guessing it depends on the court’s schedule?

Yeah, it varies. Some courts are faster than others, but no objections should speed things up.
